Governing Documents

There are three Governing Documents which define how the HOA is managed.
  1.  Declaration of Covenants, Conditions, Easements, and Restrictions
    • Document was signed and recorded in the Cuyahoga County records in March 1997
    • Includes a preamble, definitions, properties, membership & voting rights, common properties, maintenance assessment, architectural control, and general provisions
  2. Code of Regulations
    • Originally signed November 22, 2010 as AFN 201011220396
    • Amended January 22, 2017 as AFN 201701270358
    • Includes definitions, general information, members/meetings, Board of Directors/Meetings, officers, fiscal matters, assessments/liens/collections, laws/priority of documents, general provisions
  3. Rules & Regulations
    • Effective February 25, 2016
    • 17 items addressing rules for vehicles, fences, fixed structures, yard & lawns, hot tubs, exterior lighting, basketball hoops, personal property, yard ornamentation, garbage, nuisance, doors/windows, garage doors, and exposed surfaces.

Conservation Easement

This grant of a Conservation Easement, made by D. S. Acquisition & Development, Ltd., an Ohio limited liability company of, Cleveland, Ohio (hereinafter referred to as the "Grantor") to the Cuyahoga Soil and Water Conservation District ("Cuyahoga SWCD"), a soil and water conservation district, organized under Chapter 1515 of the Ohio Revised Code, whose address is 6100 West Canal Road, Valley View, Ohio 44125 (hereinafter referred to as the "Grantee").
 
  • The easement defines what is, and is not, permitted in association with property defined by the easement
  • The easement includes a map of affected property, which runs along the East Branch of the Rocky River, and relates to properties along the east side of (upper) Waterbridge Drive from Edgerton Rd. to just before the intersection with Riverview Drive.
  • The intent of the easement is to maintain the watershed in its natural condition.
  • While the property is owned by the affected homeowners, the easement controls what may or may not occur with the easement area.
